Brazil joins the Budapest Treaty:  a milestone for Biotechnology and Intellectual Property

On October 20th, 2025, Brazil has officially filed its instrument of accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for Patent Procedure at the World Intellectual Property Organization (WIPO) in Geneva, thus becoming the 92nd contracting party to the Treaty.

This important step enables Brazil to designate local institutions as International Depositary Authorities (IDAs). This, in turn, will strengthen the country’s intellectual property system and support the growth of national biotechnology, significantly reducing costs and logistical barriers for researchers and inventors who need to file a biological material for patent applications.

The joining sides with Brazil’s public policies to foster innovation, protect biodiversity, and advance scientific and technological development, and constitutes a landmark achievement as the country prepares to host COP-30.

At the same time, WIPO signed an agreement of cooperation with the Brazilian PTO (BRPTO) and the Ministry of Foreign Affairs to establish a South-South Cooperation Fund for projects with partners in Latin America and Africa. The fund will operate for four years, with an investment of R$1.5 million from the BRPTO budget.

This initiative reinforces Brazil’s role as a key player in promoting sustainable innovation and international collaboration in Intellectual Property.
